These Terms of Service (“Terms”) form a legally binding contract between you (“Customer”, “Client”, or “You”) and Joint Technology Group Inc. o/a JTG Systems (“JTG Systems”, “We”, “Us”, or “Our”).
By submitting a device for diagnostic evaluation, physical repair, data recovery, or purchasing services online or at our physical shop (23 Sharon Ave, Welland, ON), you expressly acknowledge and agree to these Terms in full.
Pre-Existing Internal & Structural Damage: Electronic devices submitted for repair often suffer from underlying micro-fractures, liquid corrosion, thermal stress, bent chassis, damaged hinge anchor assemblies, solder fatigue, or compromised board-level power rails. JTG Systems is not liable for latent or cascading component failures that manifest during disassembly, diagnostic probing, or standard reassembly resulting from pre-existing physical impact or stress.
Mandatory Customer Disclosure: The Customer is strictly required to disclose all prior device history, including liquid spills, dropped incidents, previous repair attempts by third parties, non-standard power-on routines, known battery swelling, or power anomalies. Failure to disclose known device quirks, workarounds, or prior damage forfeits any claim that subsequent operational failures were caused by our technicians.
Fragile & Glued Assemblies: Repairs involving cracked glass, delaminating digitizers, swollen lithium-ion batteries, or glued chassis components carry an inherent risk of further aesthetic or structural degradation during necessary thermal separation. JTG Systems exercises industry-standard care but assumes no liability for unavoidable deterioration of already-compromised materials.
No Warranty on Customer Parts:If a customer provides their own replacement parts (e.g., LCD screens, batteries, keyboards, charging ports, motherboards, or storage drives) purchased from third-party sellers or online marketplaces, JTG Systems installs such components solely at the customer's request and risk.
Zero Defect Liability for Customer Parts: JTG Systems provides absolutely no warranty, express or implied, regarding the authenticity, functionality, OEM compatibility, pinout integrity, or lifespan of customer-supplied parts. If a customer-supplied part is dead-on-arrival (DOA), intermittent, internally shorted, or induces board-level power rail shutoffs, labor fees for installation remain payable and JTG Systems bears zero liability for subsequent hardware faults.
Customer Backup Obligation: You acknowledge that storage media (HDDs, SSDs, eMMC, NVMe, NAND flash) can fail unpredictably during hardware testing and repair. The Customer maintains sole and absolute responsibility for backing up all data, software, passwords, and operating files prior to submitting any device.
Total Data Loss Disclaimer: Under no circumstances shall JTG Systems be held liable for any loss, corruption, alteration, or recovery failure of customer data, programs, or confidential files.
Standard diagnostics are offered free of charge. If a device cannot be repaired due to obsolete parts, extensive board-level destruction, or customer refusal of quoted work, no repair labor is billed.
However, if a repair was authorized, completed, or attempted using customer-supplied parts with standard technical care, labor fees apply as agreed upon.
To the maximum extent permitted by the laws of the Province of Ontario and applicable laws of Canada:
In no event shall JTG Systems, its officers, directors, employees, or contractors be liable for any indirect, special, incidental, consequential, punitive, or aggravated damages, including loss of profits, loss of business opportunity, lost wages, emotional distress, or loss of device utility.
Monetary Liability Cap: In the event that JTG Systems is found legally liable for any claim arising out of a service, repair, or intake agreement, our aggregate total liability shall be strictly limited to the actual amount paid by the customer for labor on that specific repair invoice, or in the case of unbilled diagnostics, capped at a maximum of $100.00 CAD.
Repairs performed using parts supplied directly by JTG Systems include a 90-Day Limited Warranty covering defects in parts and workmanship.
Warranty Exclusions: This warranty is null and void if the device exhibits post-repair liquid damage, accidental drops, cracked glass, evidence of unauthorized tampering, software viruses/malware, or user OS corruption.
Devices left in our custody for more than 60 calendar days after formal completion or diagnostic notification (via phone, SMS, or email) without payment or pickup shall be deemed legally abandoned.
JTG Systems reserves the right under the Repair and Storage Liens Act (Ontario) to dispose of, wipe, or recycle abandoned devices to offset diagnostic, storage, and administrative costs.
JTG Systems maintains a strict zero-tolerance policy against abusive behavior, threatening conduct, bad-faith public defamation, or repeated unwarranted personal home contact directed at our staff, owners, or their families.
All formal dispute communications must be conducted through professional, recognized legal channels during regular business hours.
These Terms are governed by and construed exclusively in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any legal action, Small Claims Court proceeding, or dispute arising out of or in connection with these Terms or services rendered shall be instituted exclusively in the Small Claims Court or Superior Court of Justice located within the Niagara Region, Ontario.
